Motorcycle Accident

a motorcycle is wrecked on the side of the roadMotorcycle wrecks are handled legally the same as a car accident.  However, because of the North Carolina law of contributory negligence and the reputation of some motorcycle riders, motorcycle cases provide a unique challenge.

North Carolina is one of only four remaining states with the outdated and unfair law of contributory negligence.  Contributory negligence means that if you in any way contributed to your injuries, you are entitled to no recovery.

Many people believe riding a motorcycle, in and of itself, is contributory negligence.  Although motorcycle riders are some of the safest operators on the road due to their visibility and experience in defensive driving, motorcyclists do not enjoy a reputation of safety from non-bikers.  North Carolina requires motorcycle drivers to have an additional motorcycle license.  Injuries from motorcycle wrecks are obviously more severe.  However, because you are on a motorcycle, it is likely that the insurance company will diminish your claim.

Before you are a victim, check with your insurance agent to make sure you have adequate coverage to protect you when you are riding your bike.  If become a victim, call us before you speak with anyone from an insurance company.
