Overtime Lawsuit Settles for Cintas Drivers

August 21, 2009 at 4:39 pm by Jill Hernandez | Profile

According to an LA Times article posted by the Associated Press on August 20, the California-based, work uniform supplier Cintas, has agreed to settle a class action lawsuit involving unpaid overtime pay.  The article states that Cintas said it will pay $22.8 million to a group of drivers who alleged they were misclassified as salaried employees instead of hourly employees.  The salaried employee classification allowed Cintas to avoid paying for overtime worked.

Filed in U. S. District Court for the Northern District of California, the lawsuit was settled with an arbitrator, and the settlement will require court approval before final.

I worked for Cintas from 2002 til 2009. I worked as a driver and even a supervisor for two years. Is it too late to become a part of this lawsuit or has that time passed?
I also am aware of the replacement method of written time sheets were abused by management by telling guys to write in 40 hours. When I was a supervisor they told me to \"get the overtime down\" and told me to \"strongly suggest\" they write down 40 hours or threaten to pull volume and to make sure you threaten really good volume. Of course, I refused to take part in any of this and said I live by the standard, I will not do anything I wouldn\'t want shouted from a mountain top.
This is something for your firm to look at as well.
I worked out of location 314 Evansville, IN and Paducah, Ky for 2 years.
Thank you for taking the time to read over this.
