Product Liability

Martin & Jones has long history of representing injured people, in what are known as product liability claims. A product liability claim arises when an individual is injured or killed by a defective product. The injury can occur in the home, at the workplace, in your automobile, or during recreational activities.

 

According to the United States Consumer Product Safety Commission (CPSC), every year tens of thousands of children and adults are either injured or killed by an unsafe and defective product.  Unsafe products can be found in use by any age or generation. Some examples of defective products may include a child's crib, toys, power tools, ATVs (all terrain vehicles), gas appliances and poorly made medical devices.  More often than we would like, products are manufactured in violation of existing safety standards or are manufactured improperly so that they become a hazard to those using the product.  Manufacturers sometimes delay recalling unsafe and defective products, and at other times the products are simply not recalled.  


Defective products can result in the following types of injuries:

  • Electrocution
  • Poisoning
  • Burns
  • Lacerations
  • Amputations
  • Drownings
  • Strangulation
  • Asphyxiation
  • Choking
  • Chemical Burns
  • Toxic Exposures

There are time limits in which claims must be pursued against a manufacturer or seller of a defective product.  These time periods are known as statutes of limitation or statutes of repose, and they vary from state to state.  Accordingly, if you have been injured by a product that you believe was defective or unsafe, you should contact a qualified lawyer to investigate the matter.  It is critically important to attempt to retain the product while any investigation is being pursued since without the product it would be difficult or impossible to pursue a claim.

On May 1, the U. S. Food and Drug Administration (FDA) issued a strong warning to consumers to immediately stop taking Hydroxycut brand weight loss products manufactured by Iovate Health Sciences, Inc.  Following the FDA warning, Iovate issued a recall of its Hydroxycut brand products in the United States. more >
