October 15, 2007Medtronic announced that it was suspending sales of the Sprint Fidelis lead as a result of a flaw that can lead the device to malfunction. The Sprint Fidelis lead, which connects a defibrillator to the patient's heart, can fracture inside a patient's blood vessel and deliver a massive electrical jolt.

March 28, 2006—Ethicon, Inc, a division of Johnson & Johnson, announced it would recall Panacryl sutures based on concerns that the product was not dissolving in the body as intended. The recall includes 1,061,712 sutures distributed in the United States and worldwide.

ReNu Lawsuit

April 12, 2006—Bausch & Lomb announced it would recall ReNu with MoistureLoc following reports that the contact lens solution was linked to fusarium keratitis. Fusarium keratitis is a serious fungal eye infection that can lead to blindness.

Vioxx Lawsuit

April 5, 2006—A New Jersey jury found that Vioxx caused the heart attack suffered by a long-term user of the drug. This was the first case to reach trial involving a plaintiff who had used Vioxx for a lengthy period. The jury awarded the man $4.5 million in damages.

Asbestos

March 7, 2006—The North Carolina Court of Appeals unanimously upheld a $7.5 million verdict in favor of retired CSX Transportation railroad employee, Ray Williams. Forest Horne and Spencer Parris of Martin & Jones represented Williams.

Williams worked for CSX Transportation for nearly 40 years before retiring in 1999. He was diagnosed with pleural mesothelioma in 2002. The only proven cause of mesothelioma among workers in the United States is exposure to asbestos.

Guidant Lawsuit

January 30, 2006—Martin & Jones has filed more than 30 individual lawsuits on behalf of people harmed by defective Guidant heart devices. The lawsuits were filed in federal court in the District of Minnesota. Pre-trial discovery has been consolidated in Minnesota under Multi-District Litigation procedures.

The company presently faces about 145 individual lawsuits involving its defective defibrillator and pacemaker devices, and an additional 60 class action lawsuits.

It is likely the company will face several thousand additional lawsuits over the next several years. In fact, Guidant already has been informed of more than 2,500 claims from individuals who may file lawsuits against the company.

Ketek Lawsuit

January 20, 2006—An article published in the Annals of Internal Medicine reported that Ketek (telithromycin) was linked to three cases of liver damage, resulting in the death of a North Carolina man. The article discussed three patients at the Carolinas Medical Center in Charlotte, North Carolina who were seriously harmed after using Ketek.
