Our Juul E-Cigarette Lawsuit Investigation

Martin & Jones attorneys are investigating claims against e-cigarette maker.

On September 9, 2019, the FDA issued a warning to JUUL Labs, Inc., alleging violations of federal regulations for marketing e-cigarettes as a safer alternative to traditional cigarettes. The warning came within weeks of the FDA’s announcement that they are reviewing approximately 530 lung injury cases and several deaths potentially linked to vaping from across the country.

The Center for Disease Control indicates that 67 percent of those developing respiratory illness from vaping are between the ages of 18 and 34, with more than half under the age of 25 or younger.  Dr. Schuchat, principal deputy director of the U.S. Centers for Disease Control and Prevention, called youth vaping an epidemic affecting nearly all U.S. states. Dr. Schuchat said that “flavors are a big attractor” for young vape consumers.

JUUL has built a $38 million vaping empire since its inception in 2017.  To attract youthful consumers, JUUL saturated social media viewed by teens with advertisements and used influencers. The new nicotine epidemic has arguably reversed decades of progress in protecting from nicotine addiction.  In 2018, the CDC reported that 3.6 million middle and high school students admitted to using an e-cigarette in the preceding 30 days.

The FDA is currently investigating how JUUL designed vaping devices and related products to increase addiction, particularly in teens and young users.

“Regardless of where products like e-cigarettes fall on the continuum of tobacco product risk, the law is clear that, before marketing tobacco products for reduced risk, companies must demonstrate with scientific evidence that their specific product does in fact pose less risk or is less harmful. JUUL has ignored the law, and very concerningly, has made some of these statements in school to our nation’s youth,” said acting FDA Commissioner Ned Sharpless. The FDA also indicated that the industry has been put on notice: “if the disturbing rise in youth e-cigarette use continues, especially through the flavors that appeal to kids, we’ll take even more aggressive action.”
