Company Compensates Child Severely Injured By Swimming Pool And Changes Dangerous Pool Design
A 9-year-old girl’s grandparents bought a plastic pool from K-Mart manufactured by General Foam Plastics. On the very first day of use, the 9 year old was walking up the ladder when the PVC plastic pipe railing broke and she fell across the jagged edge of the broken PVC pipe. Martin & Jones filed suit against K-Mart and General Foam Plastics. Martin & Jones retained experts who determined an unsheathed screw through the PVC pipe cut through the plastic causing the pipe railing to break. Very simple corrections were available to avoid this tragic injury. The company took responsibility for its actions, paid for its mistake and retained the expert hired by Martin & Jones to redesign its pool so that no one else would be injured by this design defect.
