Medical Students Improperly Deliver Baby Causing Permanent Injury To Arm; Case Settles For $800,000
Baby was delivered at a major medical center by medical students. At the time of delivery, these students recognized that the baby’s shoulder was stuck (shoulder dystocia) in the birth canal, but continued to try to deliver the baby without performing the appropriate maneuvers to free the shoulder. Because of the failure of the students to free the shoulder before delivery, this little girl suffered severe nerve damage to her right arm resulting in “Erb’s Palsy.” The hospital settled for $800,000, which allowed the child to have much needed surgery to repair the arm with money leftover to fund an annuity to pay the child when she reaches college age.
